1. Normal Trademark Renewal
A trademark may be renewed at any time within one year before the expiry of its registration.
Government Fee (E-Filing): ₹9,000 per class
Renewing within this period ensures uninterrupted protection of your trademark rights.
2. Late Renewal (Grace Period)
If the trademark is not renewed before its expiry, the proprietor still gets a six-month grace period to renew it.
Government Fee (E-Filing): ₹13,500 per class
This consists of:
- Renewal Fee – ₹9,000
- Surcharge – ₹4,500
Timely renewal during the grace period helps avoid the need for restoration proceedings.
3. Restoration & Renewal
Where a trademark is not renewed even during the grace period and has been removed from the Register, an application for Restoration and Renewal may be filed.
Time Limit: Within one year from the date of expiry, subject to the provisions of the Trade Marks Act and Rules.
Government Fee (E-Filing): ₹18,000 per class
This includes:
- Renewal Fee – ₹9,000
- Restoration Fee – ₹9,000
